in writing by the managing owners or directors of said club or
corporation.
SEC. 82. The said Commissioners shall, annually, designate
the time and place of holding said election, and shall give at
least two weeks' notice thereof by notices set up at two or more
of the most prominent places in said town, and ten days prior
to the first Tuesday after the first Monday in the month of
January, in each year, shall appoint three persons to act as;
judges of said election and at the same time shall appoint two
clerks for the purposes of said election; and the said judges
and the said clerks, before acting as such, shall qualify before
one of the Commissioners then in office by taking the oath here-
inafter prescribed for Commissioners or other officers of said
town; and the said judges shall open the polls of the election
at 4 o'clock P. M. on the first Tuesday after the first Monday
in the month of January, in each year, and close the same at
8 o'clock P. M. on said day; and the five persons voted for at
said election, who shall receive the highest number of votes,
shall be Commissioners for the town for the ensuing year, and
until their successors are duly elected and qualified; and the
person receiving the highest number of votes shall be the pre-
siding officer of the Board of Commissioners and shall be known
as the Mayor of said town; if there should be a tie in the highest
number of votes, the remaining three Commissioners shall, by
a majority vote, decide which of two said Commissioners shall
be the Mayor; and if more than five persons are voted for as
Commissioners and there be a tie so that five Commissioners
have not received a clear plurality vote, then and in that event
the judges of election shall have full power and authority to
decide the said tie and issue a certificate of election to such
person in said tie as they may select.
SEC. 83. If after said election that a full Board of five Com-
missioners has not been voted for and elected, and there shall
be as many as three shall be duly elected, the persons so elected
shall immediately assemble and qualify as Commissioners and
proceed to fill the vacancies of said Board from among the per-
sons living in said town and eligible for Commissioners; if the
persons duly elected as Commissioners, or majority of them,
shall fail to assemble and qualify within a period of ten days
from the date of their election the old Board of Commissioners,
or any three of them, shall assemble, and proclaim a new elec-
tion, giving five days' public notice thereof as provided for in
the general election.
