938 LAWS OF MARYLAND.

Garrett County during the months aforesaid, provided such
rabbits are shipped openly with their hind legs tied together
and tagged.

SEC. 3. And be it enacted, That it shall not be lawful for
any person to kill or have in his possession in Garrett County
upon any one day more than six of each of the above enumerated
kinds of game birds.

SEC. 4. And be it enacted, That non-residents of Garrett
County shall be permitted to hunt and kill any of the game above-
mentioned in Garrett County during the open season for the-
hunting and killing of the same as hereinbefore provided, in
condition, that he or they, each, first obtain a hunter's license
so to do, which license may be obtained upon application to any
Justice of the Peace in Garrett County upon payment by such
applicant to said Justice of the sum of ten dollars, and said
license shall be good from the date of its issue until the 31st.
day of the month of October, following such date of issue, and'
at the time of the granting of such license, the said Justice

- shall also furnish said licensee with a badge to be worn by him
while hunting upon the left sleeve of his coat in such manner
as to be readily seen, and failure so to wear such badge while-
hunting shall be prima facie evidence that such hunter has
failed to take out and pay for the license herein required; such
licenses and badges to. be furnished by the County Commission-
ers of Garrett County free of charge upon payment of the license
fee aforesaid; such license fees to be accounted for and paid
over by said Justices of the Peace to the Treasurer of Garrett
County for the use of said County, the said Justices being en-
titled to retain the sum of fifty cents out of each license fee for
their services in issuing such licenses and badge.

SEC. 5. And be it enacted, That any such non-resident hunter
shall be permitted, upon leaving the County, to carry away
with him not more than six birds of any of the above enumerated
kinds, provided he shall have actually shot and killed the same

himself.

SEC. 6. And be it enacted, That any person, firm, corpora-
tion or association violating any of the provisions of this Act
shall be deemed guilty of a misdemeanor, and upon conviction
thereof before any Justice of the Peace of Garrett County, or
before the Circuit Court for Garrett County, shall be fined not
less than fifty dollars and not more than one hundred dollars
and be confined in the County jail of Garrett County for a
