Bailiff, as the case may be, to the best of my ability, without
prejudice, fear, favor or partiality. And at their annual meet-
ing on the fourth Monday in May, the said Commissioners shall
elect one of their number as president of the Commissioners
and who shall be acting Mayor of said town, and preside at all
meetings of said Commissioners and execute all ordinances exe-
cuted by them, and who shall be ex-officio chairman of all com-
mittees appointed by the said. Commissioners. They may meet
as often as occasion may require for the welfare and good gov-
ernment of the said town, but not less than once a month.
SEC. 5. And be it enacted, That the said Commissioners of
Barton shall appoint every year, at least ten days before the
day of election, three judges to hold elections; they shall keep
the polls open from 6 o'clock to 8 o'clock in the evening and
shall conduct the said elections in the same manner that State
and County elections are now conducted as far as may be con-
sistent with the provisions of this Act. And the said Judges
shall make returns under their hands and seals to the Clerk of
the Circuit Court for Allegany County of the persons elected,
and the positions to which they have been elected.
SEC. 6. And be it enacted, That the said Commissioners, or
a majority of them, shall define the duties of the Clerk and
Bailiff and allow them such compensation for their services as
they may think proper, and all ordinances passed by the said
Commissioners, or a majority of them, shall by the Clerk be
entered in a book to be kept for the purpose, which shall at all
times be open for inspection by any person or persons inter-
ested, and copies of all ordinances, within thirty days after
their passage, shall be posted in three public places in said
town, one of which shall be at the meeting place of the said
Commissioners. Por official misconduct, or neglect of duty of
the Bailiff or Clerk during their respective terms of office, the
said Commissioners may remove the Clerk or Bailiff so offending
and elect or appoint some person or persons to fill the unex-
pired term of office so made vacant; provided, however, that
the said Clerk or Bailiff shall have at least ten days' notice
4hereof and be presented with a copy of such charge or charges
that may be preferred against them and be granted a free
and impartial hearing before the said Commissioners, before
action can be taken thereon.
SEC. 7. And be it enacted, That the said Commissioners, or
a majority of them, shall have full power and authority annually
at their first meeting on the fourth Monday in May, to appoint
