o'clock midnight and 8 o'clock A. M., or at any time on the
Lord's day, commonly called Sunday.
SEC. 9. And be it enacted, That all sums of money Received
by the Clerk of the Court under the provisions of this Act,
except the fees allowed herein and a commission of 1% on all
sums collected by him for licenses, shall be paid by him on the
first Monday of each and every month in the year, respectively,
to wit, one-fourth of twenty-five per cent, of all sums of money
derived from licenses thereof, shall be turned over to the State
Treasurer on the first Monday of each and every .month in the
year respectively, and the balance of all sums of money de-
rived from licenses under this Act, to all clubs located in the
town of Hagerstown or within two miles thereof, with the above
exception, shall be paid by him to the Tax Collector of said
town for the use of the street fund, to be applied in making
and cleaning the streets of the City of Hagerstown, and all
moneys derived from licenses issued under this Act in the other
incorporated towns shall be paid by him respectively to the
Treasurer or Tax Collector of said incorporated towns; and all
moneys derived from licenses issued under this Act elsewhere
in the County shall be paid by him to the County Tax Collector,
to be applied on Court expenses, and the bond of said clerk
shall be liable for all moneys received under the provisions of
this Act and not paid over as herein directed.
SEC. 10. And be it enacted, That any club which shall here-
after be convicted of selling intoxicating, spirituous or fer-
mented liquors or lager beer or any admixture thereof in Wash-
ington County, Maryland, without a license first having been
obtained therefor under the provisions of this Act, shall be sen-
tenced to pay a fine of not less than one hundred dollars nor
more than three hundred dollars, in the discretion of the Court
trying the case.
SEC. 11. And be it enacted, That any club or clubs having a
license under the provisions of this Act, which shall hereafter be
convicted of violating any of the provisions of this Act, or of
the conditions of its license, shall unless otherwise herein pro-
vided, be subject to a fine of not more than two hundred dol-
lars in the discretion of the Court trying the case, for the first
offense, and upon a second conviction for a violation of any pro-
vision of this Act, or the condition of its license it shall be sub-
ject to a fine of not less than fifty dollars nor more than two
hundred and fifty dollars in the discretion of the Court trying
the case, and in default of payment of any fine or costs so im-
