town, residents in and voters in such ward, who or a majority
of whom, shall be judges of election for such ward from the time
of their appointment until a new appointment shall have been
made; and it shall be the duty of said Board in making the
appointment of such judges of election to select at least one of
the said judges for each ward from among those of leading po-
litical party different from themselves or a majority of them-
selves ; if any of the said judges shall die, resign or move out
of the ward for which he was appointed, or become otherwise
in the opinion of said Board, disqualified to act as said judge
of election, then the Board of Supervisors of Election shall ap-
point a person as judge for the ward in which such vacancy
may occur; the said Board of Supervisors of Election shall re-
cord every appointment so made in a book to be kept by them
for that purpose, and they shall make out a warrant for such
appointment and shall within two days thereafter deliver it
unto the Chief of Police of the City of Hagerstown, under the
penalty of fifty dollars, who shall deliver such warrant to the
person appointed as such judge of election, or leave the same
at his last place of abode within two days next after the de-
livery of each of the said warrants to him, under the penalty
of fifty dollars; said Board of Supervisors of Elections shall
likewise cause similar warrants to be delivered to such clerks
or other officers of election as are now or may hereafter be
required by law. The compensation for each of the said judges
of election, shall be three dollars for each election, and no
more.
SEC. 161-J. Every voter shall deliver to the judges of election
in the ward in which he offers to vote, one official ballot to be
furnished to him in the manner stated in Section 161-PP of
this Article, and the ballot so delivered to and received by the
judges of election shall be deposited in the ballot-box until the
polls be closed, subject to the limitation hereinafter stated;
one accredited representative or challenger of each candidate
voted for at each election, to be designated in writing by such
candidate, and in case of his necessary absence a substitute simi-
larly selected shall be entitled to be admitted into and remain
in the polling-room from the opening until the close of the elec-
tion, and until the vote has been counted and the result ascer-
tained, and a refusal to permit any such representation shall
be a misdemeanor punishable by a fine not exceeding five hun-
dred dollars or by imprisonment not exceeding six month, or
by both fine and imprisonment, in the discretion of the Court;
