certain and find separately: First—the present value of the en-
tire lot, or the entire lot and improvements of which a part is
to be taken, as if the proposed opening, widening, extending,
straightening or closing were not to be made; and secondly—
what will be the value of the portion of the lot, or of the lot
and improvements which will remain after the opening, widen-
ing, extending, straightening or closing of said highway shall
have been made, and the grading thereof shall have been done.
If the value so found of the whole, exceeds the value so found of
the portion which will remain, the owner of said lot, or of said
lot and improvements shall be allowed the difference as net
damages. If the value so found of the part which will remain
shall exceed the value so found of the whole, then the owner of
the said lot, or said lot and improvements shall be charged the
difference as net benefits, but nothing herein shall prevent the
surrender of the whole lot, as provided in Section 176.

SEC. 2. And be it further enacted, That this Act shall take
effect from the date of its passage.

CHAPTER 126.

AN ACT to authorize the removal and the rebuilding of a new
Jail and for the purchase of the necessary appurtenances for
the same for Charles County, Maryland, and to provide for
the payment therefor.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That the County Commissioners of Charles County, Mary-
land, be and they are hereby authorized and directed to re-
move the County Jail of Charles County, Maryland, from its
present site in the village of La Plata, the County Seat of said
Charles County, Maryland, and to rebuild the same in north-
west corner of the tract of land owned by said Charles County,
Maryland, known as the Court House lot, and to purchase the
necessary appurtenances for the same.

SEC. 2. And be it further enacted, That the said County
Commissioners of Charles County, Maryland, in the manner of
removing and rebuilding a new jail for said Charles County,
Maryland, as in Section One of this provided, are hereby em-
powered and directed to either build a new jail exactly like the
old one or adopt a plan and specifications for a different kind
