fund; and the justice, upon ascertaining from the witnesses in
the case the fact .that certain sheep were killed or injured by a
dog or dogs, whether the owner of the dog has been proved or not
in the trial, shall issue to the owner of the sheep killed or injured
a certificate for the full amount of damages which shall have
been proved to have been sustained by said owner, which certifi-
cate, when endorsed by the Clerk of the Board of County Com-
missioners shall be presented to the Treasurer of Garrett County,
who shall pay all certificates when ordered so to do by the Board
of County Commissioners. The Board of County Commissioners
shall, at their first meeting in the month of January each
year, issue orders for the amount of certificates so filed, pro-
vided the amount to the credit of the sheep fund is sufficient to
pay all certificates in full. If it shall be found that the amount
of money to the credit of the sheep fund is not sufficient to pay
all the certificates in full, then the Board of County Commis-
sioners shall pay each person, who has filed his certificates, an
equal percentage on the certificates so filed, and if it shall be
found that there is more money to the credit of the sheep fund
than is necessary to pay the certificates, such balance shall each
year be transferred to the credit of the School Board; and that
if the ownership of the dog in the case is known, and the dog
has not already been killed, the justice of the peace shall require
a constable to proceed forthwith to kill such dog, and said con-
stable for such killing shall be allowed the sum of one dollar for
each dog killed by him upon such order by the justice of the
peace aforesaid, to be taxed against the owner of such dog as a
part of the costs in such case taxed; and that where the owner-
ship of any dog which has killed or injured sheel has not been
ascertained, the costs in the case shall be paid by the Board of
County Commissioners out of any money which may stand to the
credit of the sheep fund; in case of judgment being rendered
against the owner of any such dog he shall not be allowed the
exemption from execution as provided by Section 8 of Article
83 of the Code of Public General Laws.

SEC. 11. And be it enacted, That all Acts and parts of Acts
which are inconsistent with the provisions of this Act, in so far
as they relate to Garrett County, are hereby repealed.

SEC. 12. And be it enacted, That this Act shall take effect
from the date of its passage.
