1004 LAWS OF MARYLAND.

SEC. 7. And be it enacted, That if any dog shall be found
going at large off the premises of the owner or keeper or said dog
without wearing such tax as is provided for in this Act, any
resident or landowner may kill said dog found going at large
without wearing the aforesaid tag, and that any person may
kill any dog, whether tagged or not, which may be caught in the
act of killing, destroying, worrying or chasing sheep either upon
their own land or that of another, for which killing the owner
of the said dog so killed shall be debarred from recovering any
sum in any court of this State as damages for such killing.

SEC. 8. And be it enacted, That any person who shall ma-
liciously remove from any dog wearing the same, the aforesaid
tag, the annual tax having been paid, shall be fined ten dollars,
and costs, and any person killing any dog wearing any license
tag as provided by this Act, whether by mistake or otherwise,
unless caught in the act of killing, destroying, worrying or chas-
ing sheep, as provided in Section 7 of this Act, shall be liable to
the owner of said dog in an action for damages for the full
value of said dog, which value shall not be less than ten dollars,
to be recovered by the usual proceedings in such cases.

SEC. 9. And be it enacted, That any non-resident of Garrett
County may obtain a license tag for any dog in the same manner
as provided in Sections 5 and 6 of this Act upon the payment
of the tax provided for in Section 2 of this Act, but that if any
non-resident can furnish satisfactory evidence to the constable
by receipt or otherwise that he has already paid an annual license
tax upon the dog or bitch for which license is sought, the con-
stable shall then issue to the owner a tag upon the payment
of ten cents, and shall keep a record of the case as provided in
Section 5 of this Act.

SEC. 10. And be it enacted, That any person whose sheep has
been killed or injured by any dog shall go at once before a jus-
tice of the peace in his district and make affidavit before him of
such loss or injury, whereupon said justice shall immediately
issue a summons for the owner of such dog, and for such wit-
nesses as may, in his judgment, be necessary to ascertain the
amount of damages sustained by such killing or injury; and if
the owner of the dog causing the injury is known, the justice
shall forthwith give judgment for such damages as may be
ascertained, in the name of the Board of County Commissioners
of Garrett County, which shall be collected as other debts in this
State are collected, and placed by them to the credit of the sheep
