CHAPTER 64.

AN ACT to repeal the one hundred and seventh
section of Article one of the Code of Public Lo-
cal Laws for Allegany county, relating to the
Superintendant of the National Road, as re-
enacted by the act of eighteen hundred and
sixty-two, chapter one hundred and seventy-six,
and to re-enact the same with amendments
thereto.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That section one hundred and seven
of the Code of Public Local Laws for Allegany
county, as re-enacted by the act of eighteen hun-
dred and sixty-two, chapter one hundred and sev-
enty-six, be and the same is hereby repealed, and
the following enacted in lieu thereof.

107. The Governor by and with the advice and
consent of the Senate, shall biennially appoint a
Superintendant of that part of the National road
lying in Maryland, who shall, during his contin-
uance in office, reside in Allegany county, and who
shall have the care and control of said road, and
shall receive as compensation therefor the sum of
two dollars per day for each and everyday that he
shall actually, in person, superintend and labor
with a gang of not less than two able-bodied men
in the maintenance and repairs of said road, the
amount of said compensation to be ascertained by
the affidavit of the said Superintendant made quar-
terly before the Judges of the Orphans' Court of
Allegany county, and to be paid out of the tolls of
the road.

Sec. 2. And be it enacted, That this act shall
take effect from the date of its passage.
