for said county, and may be liable to be sued and
recovered upon, by said County Commissioners,
for any neglect or failure by said contractors, as in
the case of other bonds with conditions, in the Cir-
cuit Court for said county.

Compensation.

Sec. 4. And be it enacted, That the said building
committee, after the acceptance and approval of
such contract as aforesaid, shall superintend the
said work, and may during the progress thereof,
with the assent of the said County Commissioners
and of said contractor or contractors, make or au-
thorize any alteration in such plan as may seem
advisable; and the said committee shall each re-
ceive a compensation of two dollars per day for
every day of actual service in the discharge of their
duties under this act, to be paid out of the fund
hereinafter provided.

Levy to be
made.

Sec. 5. And be it further enacted, That at the next
regular levy-laying term of said County Commission-
ers, after the passage of this act, they snail-levy a
special tax sufficient to defray all the cost of the
work hereby authorized, and of all incidental ex-
penses necessary to the carrying out of this act ;

Proviso.

provided, the whole sum so levied shall not exceed
the sum of five thousand dollars, and shall be pay-
able, on the order of said County Commissioners,
to the parties respectively entitled to the same.

Commission-
ers may refuse
to accept work

Sec. 6. And be it enacted, That the said County
Commissioners shall not be bound to accept the
said work when completed, unless the same be
done in a workmanlike and sufficient manner, and
if the same be rejected by them they may refuse to
levy any compensation for said contractors, unless
required so to do by judgment of the Circuit Court
of said county reversing their said refusal upon ap-
peal, which appeal is hereby allowed.

To provide
safeguards.

Sec. 7. And be it further enacted, That the said
County Commissioners are hereby authorized and
required from the passage of this act, to provide
any additional safeguards that may in their dis-
cretion be necessary (until the completion of said
work) for the safe custody of prisoners in said jail,
and during the repair or rebuilding thereof they
may provide additional places for their custody,
and shall provide for all such expenses in the an-
nual levy.
