Sec. 2. And be it enacted, That as soon as the
said company shall have put in complete repair,
as aforesaid, not less than two miles of said road,
commencing at the southern terminus thereof, and
so on from time to time every additional mile of
said road progressing, they shall erect such and so
many gates upon and across said road as will be
necessary and sufficient, and at said gates shall be
entitled to collect the tolls which the said com-
pany were by law entitled to collect before the
passage of this act.

Sec. 3. And be it enacted, That unless the said
company shall, within two years from the date of
the passage of this act, put in complete lepair, as
aforesaid, at least four miles of said road, the
whole of said road shall revert to the County
Commissioners of Cecil county, and the said com-

pany shall forfeit all claim thereto, and all right
forever afterwards to collect tolls thereon; pro-
vided, that the repair of four miles of said road,
as aforesaid, shall in nowise give the said com-
pany the right to collect tolls or retain possession
of the other portions of said road which shall
remain out of repair after the expiration of said
two years; but all such other portions of said road
which shall remain out of repair after the time
specified as aforesaid, shall revert to the County
Commissioners of Cecil county.

Proviso

Sec. 4. And be it enacted, That after the said
company shall put up gates upon said road, they
shall keep said road at all times in thorough order
and repair; and in case they shall negligently per-
mit said road to be out of repair, so as to impede
the transportation of persons or property over the
same, and shall not use due diligence in the repair
thereof, they shall be liable to indictment, and i"f
found guilty, shall pay a fine of not more than
one hundred dollars in the discretion of the court.
