Sec. 2. And be it enacted, That all able bodied
white male citizens of this State between the ages
of eighteen and forty-five years, and not exempt
by the laws of the United States (excepting how-
ever all persons in the Army or Navy of the Uni-
ted States) shall be subject to military duty.

Sec. 3. And be it enacted, That the rolls of the
Militia prepared by Commissioners appointed by
the Governor in the several counties and Baltimore
city under the order of the War Department for
the draft of eighteen hundred and sixty-two, shall
be taken and considered to be the rolls of the Mili-
tia of the State under this act until a new enroll-
ment shall be ordered by the Governor, but the
Governor may prescribe any rules in his judgment
necessary to exclude disloyal persons from bearing
arms.

Sec. 4. And be it enacted, That the Staff of the
Militia of this State shall consist of one Adjutant
General with the rank of Brigadier General, who
until otherwise ordered by the Governor, shall act
as Paymaster General, Inspector General, and
Judge Advocate General, one Commissary Gener-
al, one Quartermaster General, and one Surgeon
General, each with the rank of Colonel; all of
whom shall be appointed by the Governor by and
with the advice and consent of the Senate, or by
the Governor during the recess of the Senate, and
hold their commissions during his pleasure; and
they shall each give a bond to the State in such
sum and with such sureties as shall be approved
by 'the Governor.

Sec. 5. And be it enacted, That the duties of the
Adjutant General shall be as follows, to wit: He
shall issue, sign and transmit all General Orders
of the Commander-in-Chief to the several officers
of the Militia, and shall keep a record of all gen-
eral and special orders and regulations, and cause
the same to be published when directed; he shall
enter of record a description of the Brigades, Regi-
ments and Companies which may hereafter be
formed, and every alteration thereof as well as of
the Volunteer forces which are now, or may here-
after be in the service of the United States, show-
ing the name, rank, date of commision, office and
residence of each, and the number and date, and
