CHAPTER 281.

377

AN ACT entitled, An Act to authorize and em-
power Moses, Lambson and James Crippen,
Executors of the last Will and Testament of
Giles Lambson, deceased, to sell and convey
certain lands in Kent county.

7, 1864.

SECTION 1 . Be it enacted by the General Assembly
of Maryland, That Moses Lambson and James
Crippen, of the State of Delaware, and Executors
of the last Will and Testament of Giles Lambson,
late of New Castle county, in the State of Dela-
ware, be' and they are hereby authorized and em-
powered to advertise and sell at public auction, in
one lot or in parcels, as to them shall seem most
beneficial to the parties in interest, and for cash
or on credit, secured by bond or mortgage on the
premises, as they may deem most expedient, all
the lands and real estate in Kent county, Mary-
land, of which the said Giles Lambson died,
seized or entitled to, and to convey by good and
sufficient deed or deeds to be duly executed and
acknowledged according to law, a good and valid
title in fee to the purchaser or purchasers, the said
lands and real estate or any part thereof, free from
the trusts of the said last Will and Testament,
and without any responsibility on the part of said
purchaser or purchasers, for the application of the
purchase money; and further, to receive and dis-
pose of the proceeds of the said lands according to
the provisions of the said last Will and Testament.

Authorized
to sell.

Sec. 2. And be it enacted, That the said Moses
Lambson and James Crippen, after deducting the
costs, expenses and reasonable commissions on the
purchase money of said real estate, shall hold the
one-eighth part of the net proceeds thereof, in
trust, for the use of Mary H. Townsend (named
in said will) during her natural life, and after her
death for her children, according to the trusts of
said last Will and Testament, and be accountable
therefore in the same manner as Trustees are
according to law.
