CHAPTER 163.
AN ACT to repeal the eight hundred and fifty
third section of Article four of the Code of
Public Local Laws, relating to walling Jones'
Falls, in the city of Baltimore, and to re-enact
the same with amendments.

Repealed.
|
SECTION 1 . Be it enacted by the General Assembly
of Maryland, That the eight hundred and fifty-
third section of article four of the Code of Public
Local Laws be and the same is hereby repealed,
and the following enacted as section eight hun-
dred and fifty-three of said article:

853. That the Mayor and City Council of Bal-
timore may, whenever they deem it necessary,
compel any individuals, companies, or bodies poli-
tic owning property binding on Junes' Falls,
within the limits of the city, to wall up such
property, so far as the same may bind on the Falls,
with a good and sufficient stone wall, to such
height as in their judgment the public good may
require, and to have the same backed up or filled
in with earth, so as to secure the same and the
adjacent property from danger of being inun-
dated with water; and the said Mayor and City
Council may, whenever they deem it necessary,
compel any individuals, companies or bodies pol-
itic to rebuild or repair, in a good and sufficient
manner, any stone wall owned by them and bind-
ing on Jones' Falls, within the city limits; and
should any individuals, companies or bodies poli-
tic neglect or refuse to wall up Jones' Falls, re-
build or repair any such wall within the limits of
the city of Baltimore, when required so to do by
the Mayor and City Council, the said Mayor and
City Council may cause the same to be done; and
they are hereby authorized and empowered to re-
cover the cost of such wall, rebuilding or repair-
ing, by suit at law, from the party or parties who
may have refused or neglected to build, rebuild
or repair such wall, and the cost of such wall
shall be a lien on the property so walled up or re-
paired.
