shall be distributed among the subscribers accord-
ing to the number of shares held by them respec-
tively; should any shares remain unsubscribed,
the said President and Managers may subscribe for
the same, and may thereafter offer them for gene-
ral subscription, or may sell or otherwise dispose
of them for the benefit of the said company.

Sec. 3. And be it enacted, That the sum of one
dollar be paid on each share of stock at the time of
subscribing, and that the remaining five dollars a
share be paid at such times and place as the Presi-
dent and Managers may direct, by twenty days
notice in two daily newspapers of the city of Bal-

timore; provided, there shall not more than two
dollars be called for at any one time, and that
there be at least sixty days interval between the
calls, and a failure to pay any instalment agreea-
bly to the call shall create forfeiture to the com-
pany of the stock of any delinquent, or he may be
sued for the same, as the President and Managers
may deem best.

Proviso.

Sec. 4. And be it enacted, That on the comple-
tion of the said railroad, or any section thereof, it
shall and may be lawful for the said company to
demand and receive for tolls and transportation of
all goods, produce, merchandize, or property of any
kind whatsoever, at the rate of not exceeding ten
cents a ton per mile, and for the transportation of
passengers not exceeding five cents per mile, or
traction thereof for each passenger.

Sec. 5 And be it enacted, That if any person
shall wilfully injure Or destroy any part of said
railway or any building, vehicle or other property
of said company, or shall wilfully obstruct the free
passage of any oar or other vehicle on said rail-
way, he or she shall be subject to a penalty of
twenty dollars, to be collected as other fines are
collected.

Penalties.

Sec. 6. And be it enacted, That the said com-
pany shall not permit any car or other vehicle to
stand on said railway except for a reasonable time
to receive and discharge passengers, produce or
merchandize
