CHAPTER 117.

Passed March
4, 1864.

AN ACT to amend an act entitled an act to in-
corporate companies to make several turnpike
roads through Baltimore county and for other
purposes; to authorize the laying down and
equipment of a railway on the Baltimore and
Reisterstown Turnpike road, between Baltimore
city and Pikesville, and the collection of tolls
thereon.

Power to
construct road.

SECTION 1 . Be it enacted by the General Assem-
bly of Maryland, That the President, Managers
and Company of the Baltimore and Reisterstown
Turnpike road be and they are hereby authorized
and empowered to lay a track of passenger iron
railway on their said road, with the necessary
turnouts, sidings, and other accessaries, between
the limits of Baltimore city and Pikesville, and
also to procure the necessary cars and other equip-
ments for the advantageous use of said railway,
and to hold and employ the said railway and ap-

purtenances as part of the assets and property of
the said company; provided, the railway be so
constructed and used as not to endanger or Injuri-
ously interfere with the ordinary use of and travel
upon the said turnpike road.

Capital stock.

Sec. 2. And be it enacted, That if the said com-
pany shall avail itself of the privileges and powers
conferred in the first section, then the capital stock
of the said company, now consisting of thirty-one
thousand nine hundred shares of six dollars each,
shall hereafter consist of forty-eight thousand nine
hundred shares of six dollars each, of which thirty-
one thousand nine hundred shares shall belong to
and be distributed among the stockholders; and
that the remaining seventeen thousand shares may
be subscribed for by said stockholders in a book
which shall be opened at the office of said com-
pany, after giving twenty days notice thereof, in
two daily newspapers of the city of Baltimore, and
which shall remain open, during office hours, for
thirty days; should the subscription exceed the
said number of seventeen thousand shares they
