church, or from one part of their farm to another
part thereof, shall be chargeable with tolls.

To purchase
lands.

Sec. 9. And be it enacted, That the President
and Directors of said company shall have power
of purchasing and holding as much lands as they
may deem sufficient for the purpose of erecting
toll-houses thereon, and having gardens thereto
attached, together with necessary out buildings
for the use of the toll gatherers.

Jurors to be
summoned.

Sec. 10. And be it enacted, That in case the
said company shall not be able to agree with the
owner or owners of any lands over or through
whose lands the said road may be made, it shall
be lawful for said company to cause any Justice of
the Peace of Frederick or Carroll counties, as the
case may be, to issue his warrant to the Sheriff;
directing him to summons twelve impartial jurors
to meet on said land on a day to be thence named,
to assess the damages sustained by said owner or
owners, by reason of said road passing through
such lands, taking into account the advantages
and disadvantages of the same, which inquisition
shall be returned to the Clerk's office, and either
party shall have the right to appeal to the Circuit
Court of Frederick or Carroll counties, as the case
may be, from the verdict or finding of said jury,

within sixty days from the date of said verdict.

Road to be
kept in repair.

Sec. 11. And be it enacted, That if the said
company, after the road is completed, shall neglect
to keep the said road in good and perfect order,
on information of such fact be given to any Justice
of the Peace of the neighborhood, within the
county where the repair ought to be made, such
Justice shall issue a precept, to be directed to any
Constable, commanding him to summons three
disinterested persons, to be named by the Justice,
to meet at a certain time and place on said road
which shall be complained of, and if the said road
shall be found by the said inquisition to be out of
order and repair, the said justice shall certify and
send one copy of the said inquisition to each of
the gate-keepers between which such defective
places shall be, and from thenceforth the tolls
shall cease to be demanded, paid or collected , un-
til the said defective part or parts shall be put in
good order and repair, as aforesaid.
