936 LAWS OF MARYLAND.

all persons erecting buildings in said town to conform thereto.
The council shall have the power to pass such ordinances not
inconsistent with law, as may be necessary, beneficial and
proper to enforce the provisions of this charter, and to pre-
scribe a penalty for the violation of any ordinances of a fine
not exceeding fifty dollars. On the committal of the offender
or offenders to the Montgomery County Jail for a period not
exceeding thirty days or until such fine or fines with cost of
prosecution are paid; provided that no term of imprisonment
shall be for a longer period than thirty days. (1) To preserve
the peace, good order and the best interests of the town. (2)
To maintain its cleanliness and health, and to this end: (A)
They shall have the same powers as the State Board of Health
of this State within the corporate limits of said town and one-
fourth of a mile outside thereof in every direction; (B) They
may adopt, provide and maintain an efficient system of drain-
age, sewerage, water and other public utilities; (C) They
shall have the full power to prohibit or regulate the construc-
tion or maintenance of privy sinks, cesspools and other de-
positories of filth or sewage within the corporate limits; (D)
They shall provide for the inspection and cleanliness of all
yards and stores; (E) They shall regulate the location, in-
spection and cleanliness of stables, cow yards and pens, all
stores and other places of business likely to be or become de-
trimental to health, and shall maintain a good sanitary condi-
tion in the streets, avenues, parkings, public places and build-
ings; (F) They shall pass such ordinances as they may deem
necessary to preserve the health of the town, suppress, prevent
and remove all nuisances or obstructions, or the depositing of
paper or trash in or upon its streets, sidewalks, parkings,
drains, sewers or water courses, or in or upon any lot or lots
adjacent thereto; prevent the sale of adulterated or decayed
food, and prohibit any and all business within the corporate
limits, as shall in their opinion injuriously affect the sanitary
conditions thereof, or be violative of existing conditions or
covenants, and to provide for imposing a fine or fines not ex-
ceeding fifty dollars in the'case of any one offence upon any
person or persons causing, creating or maintaining any such
nuisances or obstructions, including the committal of offenders
to the Montgomery County Jail for a period not exceeding
thirty days, or until the fine or fines with costs are paid; pro-
vided that no term of imprisonment shall be for a longer period
than thirty days. (3) To establish the grades of the streets,
gutters and sidewalks of said town, fix the width thereof and
prescribe the material of which they may be constructed; to
cause the sidewalks along the public streets to be graded, paved
and improved; to provide by ordinance for condemning, laying
