1306 LAWS OF MARYLAND.

in the said The Peninsular Light and Power Company, its suc-
cessors and assigns; and the said The Peninsular Light and
Power Company, its successors and assigns, be and it is hereby
authorized and empowered to grant or transfer any or all of
said property, charters, powers, franchises, privileges, immu-

nities and authorities which it may now own or be possessed of
or vested with either heretofore or by virtue hereof, or which it
may hereafter acquire.

SEC. 2. And be it further enacted, That the said The Penin-
sular Light and Power Company, its successors and assigns,
be and they are hereby authorized and empowered to raise their
present main dam a sufficient height to properly protect the
increased head of water occasioned by raising the outlet of its
present tumble dam, and to raise the outlet of said tumble dam
to a height of not exceeding two feet above its present height,
and to straighten, widen and deepen its tail race sufficiently to
permit the free escape of all used or dead water when its power
plant is running at its greatest capacity, and to maintain such
increased head of water, together with all necessary power
plants and works, appurtenances and accessories, and to such
ends to acquire all necessary property of every kind and de-
scription whatsoever, of any person or of any corporation, pub-
lice or private, as if expressly named herein, whomsoever and
wheresoever situate, within a radius of one and one-half miles
in said tumble dam in Caroline county either in fee simple, ab-
solute or for the use thereof in fee simple, or for a lesser estate
or interest, at its election, either by purchase or by condemna-
tion, and if by condemnation, then by the procedure set forth
in Article 23, Sections 251-252, or Article 23, Sections 360-365,
of the Code of Public General Laws of 1904, and to thereby
develop and utilize the whole or any part of the water power
thereby created and apply the same by any lawful means to its
full extent to the generation of electrical power or energy, and
the transmission, disposal and sale thereof to the public, and
the public shall have a right to demand and the said The Penin-
sular Light and Power Company, its successors and assigns,
shall supply to the extent of the electric power produced by it
from said source all applicants in like situation with connec-
tions and facilities for power: provided, such applicant, wheth-
er an individual or corporation, first complies or offers to com-
ply with all reasonable regulations, terms or rates of said cor-
poration, its successors and assigns.

SEC. 3. And be it further enacted, That The Peninsular
Light and Power Company, its successors and assigns, be and
they are hereby authorized and empowered to build, equip and
maintain transmission lines, with all necessary accessories and

appurtenances, from its said dam or dams and works to any
