PRIVATE ACTS. 1307

point in Caroline county, on, above or below land or water, nav-
igable or otherwise, and, in, under, along or across any high-
ways, streets, bridges or public places in said county or incor-
porated town or city of said county, subject to the municipal
law or ordinances of said county, town or city, and provided
that the consent of the authorities of said county, town or city
be first had and obtained to the end that it may appropriately
transmit, deliver, dispose of or sell its electric power, and duly
supply the public as aforesaid with the most approved connec-
tions and facilities as aforesaid; said The Peninsular Light
and Power Company, its successors and assigns, be and it is
hereby granted the right to acquire all necessary property of
every kind and description whatsoever of any person or of any
corporation, public or private, as if expressly named herein,
whomsoever and wheresoever situate within said Caroline coun-
ty for its transmission lines and necessary appurtenances and
accessories as aforesaid, in fee simple absolute, or the use
thereof in fee simple, at its election, either by purchase or by
condemnation, and if by condemnation, then by the procedure
set forth in Article 23, Sections 360 to 366, or in Article 23,
Sections 324-326, of the Code of Public General Laws of 1904,
at its election, and whichever mode of condemnation be selected
by said corporation, its successors or assigns, Sections 360-360
of Article 23 of said Code may form a part, if deemed by it ad-
visable; provided, however, there shall be no such right to ac-
quire property belonging to the State of Maryland without the
assent of the Board of Public Works.

SEC. 4. And be it enacted, That this Act shall take effect
from the date of its passage.

CHAPTER 599.

AN ACT to repeal Section 5 of Chapter 209 of the Acts of 1908,
and re-enact the same with amendments, being an Act to ex-
tend and enlarge the powers and privileges of the "Idlewild
Electric Light, Heat and Power Company of Federalsburg,
Maryland."

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sec. 5 of Chapter 209 of the Acts of 1908, be and
the same is hereby repealed and re-enacted so as to extend and
enlarge the powers and privileges of the "Idlewild Electric
Light, Heat and Power Company of Federalsburg, Maryland,"
and to read as follows:

SEC. 5. And be it enacted. That the corporation hereby
formed shall have power and is hereby authorized to construct,.
