are hereby made able and capable in law to have, purchase,
receive, possess, enjoy and retain to them and their successors,
lands, tenements, rents, annuities or other hereditaments, and
the same to grant, demise, alien or dispose of in such manner
as they may judge most conducive to the interest of the com-
pany; provided, nevertheless, that the said corporation, or body
politic, shall not at any time hold or possess property, real,
personal or mixed, the income from which shall exceed the sum
of three thousand dollars per annum.

SEC. 2. And be it further enacted, That this Act shall take
effect from the date of its passage.

. CHAPTER 434.

AN ACT to amend Chapter 333 of the Acts of the Assembly of
the year 1846, being an Act entitled "An Act to Incorporate
a Company to Make a Turnpike Road from Hagerstown, in
Washington County, to the Pennsylvania Line."

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Chapter 333 of the Acts of Assembly of the year
1846, entitled "An Act to Incorporate a Company to Make a
Turnpike Road from Hagerstown, in Washington County, to
the Pennsylvania Line," be amended in the manner following,
that is to say:

Said company shall have the right to erect upon said turn-
pike road three toll gates, provided the present location of
Gate No. 1, as defined by the Act of 1846, shall be in no wise
changed. Said Company shall have the right to remove Gate
No. 2 from its present location, just north of the town of Leit-
ersburg, to a location on said turnpike road at or near and
within one mile of the point where the Mason and Dixon Line
crosses said turnpike road. Said company shall have the right
to establish Gate No. 3 at a location on said turnpike at or
near the point where a stream of water commonly called the
"Marsh Run" crosses said turnpike to furnish power for the
mill of J. H. Zeigler. Said company shall have authority to
purchase or rent any realty necessary for toll houses at these
new locations, and to sell any realty now owned by said com-
pany and used for toll houses which may be no longer used for
such purposes by virtue of this Act. The rates of toll on said
turnpike shall remain the same as those established by Chapter
200 of the Acts of the General Assembly of Maryland of the
year 1865 for Gate No. 2; the rate of toll for Gates Nos. 1 and 3
