1164 LAWS OF MARYLAND.

SEC. 9. And be it enacted, That before the said streets, as
herein provided, shall be built or constructed, it shall be the
duty of the Mayor and Council of Easton to complete the curbs
and gutters on both sides of said streets to be improved, and
sufficient funds will be appropriated out of the Easton Street
Improvement Fund to defray the town's proportion of the ex-
penses incident thereto.

SEC. 10. And be it enacted, That the Commission so ap-
pointed shall within thirty days after the passage of this Act
organize by electing one of their number President, and by elect-
ing a secretary and treasurer, who shall be a taxpayer and
qualified voter of the town of Easton, and who shall not be a
member of this Commission. The salary of the secretary and
treasurer, which shall be fixed by the Commission, shall not ex-
ceed the sum of fifty dollars ($50) per month. He, the said
treasurer, shall give such bond for the faithful performance of
his duties as the Mayor and Council shall require and at the
expiration of his term of office shall turn over all moneys,
books and papers belonging to his office to the Mayor and
Council of Easto'n. All expenses incurred in connection with
the construction of the said streets, including curb and gutter
work, mentioned in Section nine (9) of this Act; materials,
labor, stationery, office expenses and the cost of bonds, shall
be paid out of the "Easton Street Improvement Fund," and no
part of this fund shall be used for any other purpose than to
p'ay the costs incident to the carrying out of the provisions of
this Act

SEC. 11. And be it enacted, That whenever competitive bids,
including bids for bonds, materials or labor are invited by the
Mayor and Council of Easton or the said Commission, by pub-
lic advertisement, and bids thus invited where the aggregate
cost equals or exceeds one hundred dollars ($100), the success-
ful bidder or bidders shall within five days after the contract
is awarded to him, them or it, make and file with the town
clerk an affidavit or affidavits to be taken before such officer au-
thorized to administer oaths by the laws of this State or such
other State, District or Territory, that he, they or it have not
conspired or colluded with any bidder or bidders at said bid-
ding for the purpose of suppressing or limiting competition,
or creating a deceptive show of competition at said bidding, or
conspired or colluded with any official of the town of Easton or
with any Commissioner or employee of the same, and in case
said affidavit or affidavits are not made and filed within the
said period of five days, as aforesaid, the Commission or
Mayor and Council may, at their option, rescind said contract.
