CHAPTER 338.
AN ACT to repeal Sections 260, 261 and 262 of Article 4 of
the Code of Public Local Laws of Maryland (Revised Edi-
tion of 1915), title "City of Baltimore," sub-title "Auc-
tions," and to add a new section to said Article, said new
section to follow immediately after Section 259 of said Arti-
cle and to be known as Section 259 1/2; the same fixing the
rate of commission to which auctioneers shall be entitled.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 260, 261 and 262 of Article 4 of the Code
of Public Local Laws of Maryland (Revised Edition of 1915),
title "City of Baltimore," sub-title "Auctions," be and the
same are hereby repealed.
SEC. 2. And be it further enacted, That a new section be
and the same is hereby added to Article 4 of the Code of Pub-
lic Local Laws of Maryland (Revised Edition of 1915), title
"City of Baltimore," sub-title "Auctions," said new section to
follow immediately after Section 259 of said Article, to be
known as Section 259 1/2, and to read as follows:
259 1/2. All auctioneers licensed under the provisions of
this sub-title shall be entitled, unless a previous agreement to
the contrary is made, to demand and receive for their services
the following commissions, whether sales conducted by them
are made under orders of court or otherwise: On all sales of
real estate, leaseholds and other interests in real property up
to and including $1,000, a commission of two and one-half per
cent.; over $1,000 and up to and including $5,000, a commis-
sion of two per cent; over $5,000 and up to and including
$10,000, a commission of one and one-half per cent.; on all
over $10,000 a commission of one per cent.; provided that in
no case of a sale of real estate, leasehold and other interests in
real property shall an auctioneer be required to accept a com-
mission amounting to less than $10. Auctioneers shall also be
entitled to demand and receive a fee of $10 in cases where real
estate, leasehold or other interest in real property is advertised
and offered for sale, but no sale is made; and a like fee of
$10 in cases where real state, leasehold or other interest in real
property is advertised for sale but is withdrawn before the day
of sale.
Auctioneers shall also be entitled, unless a previous agree-
ment to the contrary is made, to demand and receive on sales
of personal property whether under an order of court or other-
