to the best of my knowledge and ability, without fear, affection
or partiality."

SEC. 85C. The president and commissioners of said town
shall, at some meeting prior to the first Monday in May, appoint
some person to act as judge of said election, who, before acting
as such, shall qualify in the same manner as judges of election
for State and county offices in this State are required to qualify,
before a justice of the peace, and shall open the polls at 1
o'clock P. M. on the first Monday in May in each year, and close
the same at 6.30 P. M. on said date, and the persons voted for
president as aforesaid at said election who shall receive the
highest number of votes shall be president as aforesaid, and the
persons in number, according to this section, voted for at said
election for commissioners of said town, who shall respectively
receive the highest number of votes, shall be commissioners as
aforesaid, and in case of a tie, the election for president or
commissioners aforesaid, a new election shall be held, after
giving at least five days' notice of the time for holding the
same.

SEC. 89. The said board shall annually appoint by ballot a
treasurer, who shall be selected from among the members of
said board, whose duties it shall be to receive and receipt for
all monies belonging to said corporation or to which it shall be
in any wise entitled, to collect and receive all taxes, general or
special, levied upon the assessed value of all property within
said town, and to receive the fines and penalties imposed by
said board and to discharge such other duties pertaining to his
office as are, or may be imposed by law or any ordinance of the
said board; provided, that before entering upon the duties, of
said office the said treasurer shall annually give bond to the
said president and commissioners, with surety or sureties, to be
approved by said board, in double the amount of money, which
said board shall estimate will come into the hands of said
treasurer during the term for which he shall be appointed,
conditioned for the faithful discharge of his duties as said
treasurer, and the said board shall have authority at any time
to require the said treasurer to give additional bond or security
conditioned as aforesaid, for the amount of money in his hands
or to come into his hands during his term of office shall be
greater than is estimated as aforesaid by said board. Said
.treasurer shall continue in office until his successor is appointed
and qualified, but shall be subject to removal by said board for
neglect of duty, disobedience of orders or other malfeasance in
office. As the entire compensation for his services which he
shall render under and by virtue of the powers and duties con-
ferred and laid on him by this Act, or the ordinances of said
