and all vacancies arising from death, refusal to act, resignation
or otherwise, among the members of said Commission other
than the members of the Board of Public Works.

SEC. 4. And be it further enacted. That as soon after the
passage of this Act as possible said Commission shall organize
and proceed to elect a secretary, and decide upon the site of
said new warehouse, as hereinbefore limited, and procure plans
and specifications for said warehouse; and as soon as plans and
specifications are determined upon by it the said Commission
shall invite sealed proposals, by advertisements, for a reasona-
ble time, in two of the daily newspapers of Baltimore city, for
the construction of said warehouse and the equipment thereof
with suitable appliances for a tobacco warehouse, according to
said plans and specifications, which proposals shall be sent in
sealed envelopes, in care of the Secretary of State, " addressed to
said Commission, and shall be publicly opened by said Commis-
sion on the day and at the time and place named in said adver-
tisements. Said proposals shall set forth the amount of money
for which the party or parties proposing will construct the
warehouse according to said plans and specifications, and the
time or times at which payment therefor shall be made, and the
time or times when said warehouse will be completed; and the
said Commissioners shall award the contract to the lowest re-
sponsible bidder or bidders, upon such bidder or bidders giving
bond to the State of Maryland in such penalty and with such
security as said Commission shall determine, conditioned for
the faithful performance of the contract entered into, which
bond shall be liable, at the suit of the State of Maryland, for
the violation of any or all of the conditions. Said Commission
is hereby authorized and required to employ a skillful and com-
petent architect, who, subject to the approval of said Commis-
sion, shall prepare said plans and specifications, and supervise,
as to workmanship and materials, the erection of said ware-
house; and said Commission shall in like manner determine
upon proper appliances, equipments and furniture for said
warehouse and the office to be erected therein, and shall, at such
time as it may deem proper, advertise for proposals for the
same and award a contract therefor to the lowest responsible
bidder, who shall give bond for the faithful performance of the
contract as is hereinbefore required to be given by the con-
tractor for the erection of said warehouse.

SEC. 4A. And be it further enacted, That as soon after organi-
zation as practicable, the said Commission shall determine
whether the tobacco warehouse fund in the State Treasury,
after compliance with the preceding provisions of this Act, will
permit of repairs to the old State Tobacco Warehouses in the
