1502 LAWS OF MARYLAND.

JOINT RESOLUTION No. 5.

Commemorating the eminent services rendered the State of Maryland

'by the Honorable Lloyd Lowndes, the Honorable Louis E. McComas

and the Honorable James McSherry.

Whereas the people of this State, notably those residing in Western
Maryland, have been called upon to mourn the loss of three of their
honored citizens and devoted public servants.

The one, Honorable Lloyd Lowndes, because by adoption a citizen of
Western Maryland, and by his force of character and ability was
chosen to represent his district in Congress, and later called to the
highest position in the gift of the State, occupying the Governor's chair
from 1896 to 1900.

The Honorable Louis E. McComas, representing our State in both
halls of Congress with credit and distinction, and later honored by
the National Government in his appointment to the bench in the
capital of our nation, where he faithfully discharged his duties and was
honored and respected by his associates.

The Honorable Judge James McSherry, a native of Frederick, was
pre-eminently a jurist, and the high quality of mind and heart which
he possessed added new lustre to the already renowned Bench of the
State of Maryland, and his loss to our highest court has left a gap
which will be felt for many years, while his kindly and genial nature
endeared him to all with whom he came in contact.

Each of these citizens have devoted the best years of their lives
to services of their State and furnished an example of honesty and
marked ability in the discharge of public duty.

Therefore, be it resolved by the General Assembly of Maryland, That
in the death of Lloyd Lowndes, Louis E. McComas and James McSherry.
the State has been deprived of the service, counsel and judicial power of
men of marked ability, devotion to duty and highest personal integrity.

Resolved further, That as a mark of respect to the said deceased
citizens a copy of these resolutions be bound with the Acts of Assembly
for the session of 1908, and that copies thereof, properly engrossed and
under the Great Seal, be forwarded by the Secretary of the Senate to
the families of each of the said deceased citizens.

JOINT RESOLUTION No. C.

Directing the Attorney General to collect for the State of Maryland
by appropriate proceedings, from the Baltimore and Ohio Railroad
Company, such taxes on the gross receipts of the Baltimore and Ohio
Railroad Company as may be due from said company to the State
of Maryland.

Be it resolved by the State of Maryland. That the Attorney General
be and he Is hereby empowered and directed to forthwith take all such
proceedings as he may deem proper and appropriate to recover and
collect for the State from the Baltimore and Ohio Railroad Company
taxes due on the gross receipts of said Baltimore and Ohio Railroad
Company at a greater rate than has heretofore been paid by said
company, and as such taxes on the gross receipts of said company may
have heretofore accrued, or may hereafter accrue and be owing at the
time of the institution of proceedings, as aforesaid, or of judgment or
decree therein.

And be it further resolved, That this joint resolution shall take
effect from the date of its passage.
