PRIVATE ACTS. 1321

Maryland, session of 1904, entitled An Act to repeal and re-
enact with amendments section 2 and section 12 of the Acts of
the General Assembly of Maryland, 1902, chapter 357, entitled
An Act to incorporate the Kent and Cecil Light, Power and
Railway Company, be and the same is hereby repealed and re-
enacted with amendments, so as to read as follows:

2. That the object and purpose of this company shall be to
provide improved communication from that part of Kent
county, Maryland, bordering on the Chesapeake Bay, by or else-
where by the way of Chestertown, Kent county, Maryland, and
to continue through Kent county to Cecil county, Maryland,
and through Cecil county to the Delaware line, or also through
Cecil county to the Pennsylvania line or some point on the Sus-
quehanna river.

12. That the said company is authorized and empowered to
manufacture, furnish sell and use steam, electricity, electric
power and lights in Kent and Cecil counties of this State and to
manufacture, sell or otherwise deal in electricity and electrical
machinery and supplies, and to use all necessary means to
effect the objects of this incorporation; to establish lines of
electric railway conductors and conduits in Kent and Cecil
counties, and to use therefor any of the public roads, streets,
alleys or highways in Kent and Cecil counties; provided, the
consent of the proper authorities having jurisdiction over said
public roads, streets, alleys or highways may first be obtained;
and for the purpose of obtaining rights of way, where said com-
pany can not agree with the owner, or where the owner is feme
covert, under age, non compos mentis, or under any other legal
disability, said company may proceed to condemn and acquire
the use thereof in the manner provided in article 23 of the
Code of Public General Laws; and the said company is further
authorized to construct, lay, erect and operate in Kent and
Cecil counties lines of wires, tubes, poles, conduits and other
appliances necessary to supply, use and furnish electricity,
electrical currents and power for all commercial purposes, and
to charge and collect such rents, rates and charges for the use
thereof as may be agreed upon; and is authorized to transact
any business to which electricity may be applied within Kent
and Cecil counties, State of Maryland. The railroad or rail-
roads permitted to be constructed under the provisions of this
Act shall be completed within the time of five years from the
passage of this Act, otherwise the powers and privileges con-
ferred and granted under this Act, are hereby declared to be
null and void and repealed; provided, however, that nothing in
this Act, or in the general laws of this State authorizing the
condemnation of property for the purposes set forth in this
