1262 LAWS OF MARYLAND.

aud with the approval of the Governor of the State, that judges
Henry Page, Charles E. Phelps, James W. Dennis and Henry
Lloyd, judges of the courts of this State, who have by reason of
continued sickness become unable to discharge the duties of
their said office with efficiency, be retired from the said office
of judge, upon condition, however, that the said judges shall
continue to receive the salary of their office as now provided
until the end of the term for which they were respectively
elected, and from the end of said term they and each of them
shall be entitled to receive the full salary provided for in sec-
tion 46 of article 26 of the Code of Public General Laws of
1904, in the same manner as provided for therein for judges
who have reached the age of seventy years, after having served
ten consecutive years as such judge. '

SEC. 2. And be it enacted, That this Act shall take effect on
the first day of May, A. D. 1908.

CHAPTER 335.

AN ACT to refund to Joseph M. Mattingly, C. Benedict Green-
well, J. Phillip Greenwell and Susan M. Coombs, all of St.
Mary's county, Maryland, monies erroneously paid by them
into the State Treasury.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That the Comptroller of the Treasury be and he is hereby
authorized and directed to draw his warrant upon the State
Treasurer in favor of the said parties and for the respective
amounts in favor of Joseph M. Mattingly for the sum of eigh-
teen dollars and ninety cents; in favor of C. Benedict Green-
well for the sum of ten dollars and thirty-six cents, and in
favor of J. Phillip Greenwell for the sum of two dollars and
sixty-two cents; and in favor of Susan M. Coombs for the
sum of two dollars and seventy-three cents, being sums of
money erroneously paid by said parties into the State Treasury
for taxes, the same having received the recommendation of the
State Treasury officials.

SEC. 2. And be it enacted, That this Act shall take effect
from the date of its passage.
Approved April 6, 1908.

CHAPTER 336.

AN ACT to refund to The Hubbard Fertilizer Company of Bal-
timore City a sum of money erroneously paid by it into the
State Treasury.
