displacement, tonnage and motive power of all vessels which
shall navigate the back water formed by its said dam or
dams, and erect, equip and maintain all dams, feeders, aque-
ducts, locks, wharves and basins and such other appurtenances
and accessories thereto as may be necessary, and in order to
acquire the necessary property for each of the objects aforesaid
shall have all the powers of section 3 herein, as well as such
powers contained in said charters of the proprietors of the
Susquehanna Canal and Tidewater Canal Company as are
duly applicable to such acquisition, without limit to, the
quantity of land to be condemned except the necessity of said
corporation as by it determined. B. To acquire, own and
hold by purchase or otherwise the stock, franchises, property
or assets of, or exchange stock with, merge with or consoli-
date with the said Tidewater Canal Company or the proprie-
tors of the Susquehanna Canal or the "Susquehanna Canal and
Power Company," a corporation of Pennsylvania, or of any
other corporation or association, whatsoever or wheresoever,
and also to assume, pay or guarantee any indebtedness or con-
tracts of any other corporation or association on such terms
or conditions as may be mutually agreed upon. C. To charge
and collect tolls for the navigation of the bed of said river-
above its dam or dams or of the tail-races thereof, not exceeding
the rate of two cents per ton per mile, as a remuneration to
said corporation for the improvements aforesaid.
SEC. 6. And be it further enacted, That all power and au-
thority hereby granted the said Susquehanna Power Company,
its successors and assigns, whether as a corporation for the
creation, delivery and transmission of electrical energy, or
for the establishment of a real and complete navigation of the
Snsqnehanna river, whether by means of its dam and back
water, or its canals, or both together, shall be construed to be
granted for the equal benefit of the public without prior or
preferred right in the public to demand the right of naviga-
tion or the right of connection or facility for electrical energy
in derogation or exclusion each of the other or vice versa, but
so far as said public is concerned, each of said rights shall
stand and be maintained as nearly as possible in equal rank, en-
titled to be recognized and performed equitably and with
equal favor; provided, that in every such dam so constructed
by said company the said company shall construct and main-
tain sufficient fish ways or fish ladders to permit the passage
of fish from the waters below to the waters above any such dam.
SEC. 7. And be it further enacted, That the said corpora-
tion, so far as its gross receipts may result from the sale of
electric energy shall be subject to the provisions of chapter
