its electric power, and duly supply the public as aforesaid with
the most approved connections and facilities as aforesaid;
and in order to accommodate the public as aforesaid, said
Susquehanna Power Company, its successors and assigns, be
and it is hereby granted the right to acquire all necessary
property of every kind and description whatsoever of any per-
son or of any corporation, public or private, as if expressly
named herein, whomsoever and wheresoever situate, for its
transmission lines and necessary appurtenances and accesso-
ries as aforesaid, in fee simple absolute, or the use thereof in
fee simple, at its election, either by purchase or by condemna-
tion, either in the manner set forth in said Act of 1900, chap-
ter 248, or in article 23, sections 360 to 366, or in article 23,
sections 324-326 of the Code of Public General Laws of 1904,
at its election, and whichever mode of condemnation be se-
lected by the said corporation, its successors or assigns, sec-
tions 360 to 366 of article 23 of said Code may form a part, if
deemed by it advisable; provided, however, that there shall be
no such right to acquire property belonging to the State of
Maryland without the assent of the Board of Public Works.
SEC. 5. And be it further enacted,, That in consideration of
the construction by the said Susquehanna Power Company, its
successors or assigns, of a dam or dams in, aloug or across the
said river and its shores, and the canals, railroads, ferries or
highways thereon, therealong or leading thereto, and backing
the waters of said river, thereby either singly or in series to
the elevation to which such dam or dams may be erected, and
either with or without the aid of the canals hereinafter men-
tioned, said Susquehanna Power Company, its successors and
assigns, be and it is hereby declared to be also a slack-water
navigation company, with all the powers and authorities of
the charters of the Tidewater Canal Company and the propri-
etors of the Susquehanna Canal to the end that in aid of the
powers of Congress it may create a safe and practical naviga-
tion up and down said river, either upon the bed thereof, by
means of said back water or otherwise, or by means of a canal
or canals along the margins thereof, or by means of such
methods conjointly, either above or below said dam or dams, to
the end that real navigation of said river above tidewater in
Maryland, heretofore so often unsuccessfully attempted, may
now be established, and in addition to its present powers,
the said Susquehanna Power Company, its successors and
assigns, is hereby vested with the following exclusive powers,
liberties, privileges, benefits, franchises and immunities, that
is to say: A. To cut, re-cut or enlarge canals along the shores
of said river, with dimensions commensurate with the beam,
