1106 LAWS OF MARYLAND.

146. And be it enacted, That the policemen and street
supervisor, before entering upon the duties of their office, shall
each take and subscribe before a justice of the peace of Wi-
comico county residing in said city an oath to well and faith-
fully, without partiality or prejudice, perform the duties of his
office in all things according to the laws of the State and the
ordinance of said city, and to enforce said laws and said ordi-
nance to the best of his ability, which oath shall be certified to
by the justice of the peace before whom it is taken and filed
with the clerk of the Council, and be recorded in the minutes of
said Council and the original certificate safely kept. The
original certificate, the record thereof or a certified copy of the
same under the hand of said clerk and the seal of the Mayor
and Council to be evidence in any court in the State.

147. And be it enacted, That the said policemen and street
supervisor so appointed shall have all the police powers of con-
stables in this State, and it shall be their duty to enforce the
by-laws, resolutions and ordinances of said city and the laws
of the State of Maryland relating to crime and misdemeanors-
committed in said city. The Mayor, or in his absence or dis-
ability, the president of the Council, may appoint special police-
men, with all the powers of the regular policemen, for a terra of
not exceeding forty-eight hours when deemed necessary so to
do, the one appointing to fix the compensation of said special
policemen; their duties and powers shall be the same as those
of the regular policemen. Policemen shall have the same fee»
for making arrests for infraction of the laws of the State and
the ordinance of the city as are now or may hereafter be
allowed constables in criminal cases. All fines for violation of
the provisions of this charter or ordinance of the city shall,
when collected, be immediately paid over to the clerk of the
council, with the names of persons from whom collected, and
deposited by him to the credit of said city.

148. And be it enacted. That upon complaint in writing and
a trial before the Mayor and Council, after notice to the party
complained of informing him of what he is charged and to
appear and defend himself first having been given him in writ-
ing at least five days before trial, and if Council find any of said
officers including the clerk to the Council, treasurer or collector,
as hereinafter provided for, to be guilty of misconduct unbecom-
ing an officer, disobedience, neglect of duty, misfeasance or mal-
feasance in office, such officer may be removed at once from his
office by a majority vote of the trial board and his office shall be
declared vacant, and the Mayor shall, as soon as convenient
thereafter, appoint another person to fill said office so vacated
for the unexpired term, which appointment shall be submitted?
