to the Council for confirmation, and when confirmed the
new appointee shall take the same oath of office as taken by
the removed officer and in the same manner, and to be returned
to the clerk of the Council and recorded as heretofore pro-
vided, and the new officer shall have the same powers and
duties as if he had been appointed in the first place and serve
out the term of the removed officer.
149. And be it enacted, That at the first regular meeting in
July in each year the Mayor shall appoint one person, a resi-
dent and qualified voter of this city, not a member of the Coun-
cil, to act as clerk to the Council, collector of city taxes and
treasurer, who shall be the same person, for the term of two
years, or until his successor is duly qualified, subject, as other
officers appointed, to confirmation by the Council. The said
officer to receive a salary of nine hundred dollars per year, and
he shall perform all the duties imposed on him by law or ordi-
nance of the city.
150. The said clerk, treasurer and collector, before entering
upon the performance of the duties of his office, shall take and
subscribe to an oath before a justice of the peace residing in
said city that he will well and faithfully perform the duties of
his said office according to law and the ordinances of said city,
which oath is to be returned to the Council and recorded as
provided for the oaths of other officers, which oath, record of
same or a copy thereof are hereby made evidence in any court
of this State. He shall give bond to the State of Maryland
in an amount at least equal to the amount of the taxes levied
with a fidelity or surety company, qualified to act as surety or
guaranty under the laws of the State of Maryland, as surety,
conditioned that he will well and faithfulty perform the duties
of clerk, treasurer and collector of taxes in all things accord-
ing to law and the ordinances of the city, and that he will well
and truly collect the taxes levied for the use of said city of Salis-
bury and account for and pay over all moneys that may come
into his hands as clerk, collector or treasurer in the manner
and as required by law and said ordinances. Said bond shall be
paid for by the Mayor and Council. The said bond shall be ap-
proved by the Council and spread upon its minutes, and then
delivered with the approval endorsed thereon to the clerk of the
Circuit Court for Wicomico county for record, a certified copy
of the same from either record to be evidence in any court of
this State. If appointee shall fail or neglect to give satisfac-
tory bond within fifteen days, unless the time be extended by
the Council, from the date his appointment is confirmed, the
Mayor shall appoint some other person to said office, to be con-
firmed as aforesaid by the Council and to give bond as afore-
