Unlawful to
issue license.
|
Court for Garrett county to issue to any person or corporation
a license to sell spirituous or fermented liquors or lager beer in
Election District No. 2, commonly known as Friendsville or
Shelbyeport district in Garrett county, after the first day of
May, in the year eighteen hundred and ninety-eight.
SEC. 2. And be it enacted, That this Act shall take effect on

the first day of May, eighteen hundred and ninety-eight, and
it shall also be unlawful for any person or persons, firm or cor-
poration within eaid Election district No. 2, generally known
as Friendsville or Selbysport district to take orders for any
such liquors, medicated bitters or alcoholic compounds at any
time under any pretence, in any manner or for any purpose
whatever, and if any person shall therein take any order or
orders thereof, then such person or persons, the members of
such firm and the directors, trustees or managers of such corpo-
ration so doing shall be guilty of a misdemeanor, and on con-
viction thereof in the Circuit Court of Garrett county or before

Penalty.

any justice of the peace thereof shall for every offense be fined
not less than fifty, nor more than three hundred dollars, or be
sentenced to the Maryland House of Correction for not less
than three nor more than six months; or both tine and impris-
oned, in the discretion of the court of justice.

CHAPTER 78.
AN ACT to repeal and re-enact with amendments Chapter
621 of the Acts of the General Assembly of 1 894, entitled
"An Act to Incorporate the Town of Kensington, in Mont-
gomery County, Maryland."

Repeal.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That chapter 621 of the Acts of the General
Assembly of 1894, entitled "An Act to Incorporate the Town
of Kensington, in Montgomery county, Maryland," be and
the same is hereby repealed and re-enacted with amendments,
so as to read as follows :
SEC. 2. The citizens of the town of Kensington, in Mont-

gomery county, are hereby created a body corporate, by the
name and style of the town of Kensington, with all the pow-
ers and privileges of a body politic and corporate, and by said
corporate name may have perpetual succession, sue and be sued,
plead and be impleaded in any court of law or equity, and may
have and use a common seal.
