Proviso.

which said sum, when collected, less cost of collection, shall be
applied to this purpose and none other ; provided, that in mak-
ing the contract for water they shall bind the company, corpo-
ration or individual, to keep the water works in complete
repair and working order, and continue their working at such
periods and intervals as will furnish and fully supply water
sufficient at least to protect the whole town from fire, and
furnish, maintain and supply pipes, mains and plugs sufficient
for said purposes, the performance of said agreement to be a
condition precedent to the payment of the rent for said water.
No contract to be made for more than ten years at a time.
SEC. 2. And be it enacted, That the Mayor and City Council

may, in their discretion, require a bond for the faithful per-
formance of any contract for water, in such penalty as they,
the Mayor and City Council, may prescribe.

When tax to
be levied.

SEC. 3. And be it enacted, That this Act shall not be con-
strued to authorize the actual levy for the additional tax here-
inbefore authorized until the water works are completed, pipes
laid and water in a condition to be furnished.
SEC. 4. And be it enacted, That in making the contract for
water with any company, corporation or individual, they shall

bind said company, corporation or individual, to receive and
admit into the board of directors or managers of said company,
corporation or individual, two directors or managers, said direc-
tors or managers to be appointed annually by the Mayor and
City Council as their representatives, and to have the same
power and duties as the directors or managers elected or chosen
under and by virtue of the charter or by-laws of said company,

corporation or individual ; provided, however, that neither the
Mayor nor any member of the City Council shall be eligible as
directors or managers on the. part of the town.

Effective.
|
SEC. 5. And be it further enacted, That this Act shall take
effect from the date of its passage.

CHAPTER 43.
AN ACT to amend the charter and to extend the powers of
the Maryland Casualty Company of Baltimore City, a cor-
poration formed under Article 23 of the Code of Public
General Laws of Maryland, entitled "Corporations," and
changing the title of said corporation to "Maryland
Casualty Company."
