LAWS OF MARYLAND.

Construct an
electric
light and
power plant

SECTION 1. Be it enacted ly the General Assembly of Mary-
land, That the Mayor and Council of Rockville be and is
hereby authorized and empowered to construct, erect or acquire
by purchase an electric light and power plant for said town,
erect poles, string wires, swing or erect lamps, and do all other
necessary and proper acts in connection therewith, and to con-
tract for, purchase in fee simple, or lease for a term of years,
renewable at itg pleasure, any land or real estate which it may
deem necessary and expedient for a location or sight for the
same. If for any cause said Mayor and Council of Rockville
shall be unable to agree with the owner of any real or lease-
hold estate for a location or site for said plant, or if such owner
is under any disability or incapacity to contract, or is absent or
unknown, said Mayor and Council of Rockville is hereby
clothed with power of condemnation under the right of emi-
nent domain, as provided in section 167 of Article 23 of the
Code of Public and General Laws of Maryland, as fully as if
said section had been incorporated herein, and its manner and
procedure on condemnation for the purpose of this Act shall
in all particulars be the same as provided by said section 167
of Article 23.

SEC. 2. And be it enacted, That said Mayor and Council of

Rockville is hereby authorized and empowered to do all acts
necessary and proper to carry out the provisions of this Act,
and shall have full power and control over said plant, poles,
wires, lamps, etc., with authority to employ such superintend-
ents, firemen, workmen and other employes as may be neces-
sary and proper to carry on same, and to purchase all supplies
and material needed in conducting, maintaining and repairing
the same, and also to provide rules and regulations for supply-
ing said town and the citizens thereof with the electric lights
and power, and to fix and establish, and from time to time to
change a schedule of rates and charges to be made and collected
for the use of electric lights and power by private citizens, and
the bailiff shall, under such rules and regulations as shall from
time to time be prescribed by the said Mayor and Council of
Rockville, collect said charges and pay over the same to the
said Mayor and Council of Rockville.

SEC. 3. And be it enacted, That the title to said electric
plant, including poles, wires, transformers, street lamps, and
other necessary appliances and parts thereof whatsoever, and
all property belonging and pertaining thereto, shall be vested
in the said Mayor and Council of Rockville, and any person
who shall wilfully injure or destroy any machinery or other
