LAWS OF MARYLAND.

sioners, with power and authority vested in them, or a majority
of them, to extend, lay out and to grade, pave, macadamize or
otherwise improve Washington street, from its present ter-
minus through said city limits and Brooke avenue, contingent
thereto, and lying between Green and Fayette streets, in said
city.

Powers
granted.

SEC. 4. And le it enacted, That said Commissioners shall
have all the powers, and their proceedings shall be conducted
in the same manner as if they were appointed by the Mayor
and City Council of Cumberland, Maryland, in accordance
with the charter of said city.

Receive com
pensation.

SEC. 5. And be it enacted, That the said Commissioners
shall receive compensation for the services to be performed by
them, at the rate of two dollars per day for each day actually
employed ; provided, hpwever, that the total compensation of
each Commissioner so acting shall not exceed the sum of
twenty-five dollars ; and said Commissioners shall further em-
ploy a competent surveyor or civil engineer to make the sur-
veys and estimates of said work, and fix his compensation
therefor.

SEC. 6. And be it enacted, That said Commissioners, as soon
as said work is fully completed, shall make a report of their pro-

ceedings hereunder to the Mayor and City Council of Cumber-
land, Maryland. Said Commissioners herein named shall desig-
nate what, sum shall be paid by the city of Cumberland toward
said tfork, and whatever sum may remain shall be apportioned
amongst the owners in fee simple of the property binding oh
the improved part of said Washington street extended and
Brooke avenue; provided, however, that the total amount so
apportioned amongst the said property holders shall not exceed
two-thirds of the entire cost of said improvement.

Who assess -
ments are
due and
owing to.

SEC. 7. And he it enacted, That all assessments made under
the preceding section shall be considered as due and owing to
the city of Cumberland, and shall be collected by the Mayor
and City Council of said city in the same manner as assess-
ments made under the provisions of its present or amended
charter; and all amounts allowed by said Commissioners herein
as damages, if any, shall be allowed, and all costs attending the
laying out and extension of said Washington street, and the
grading, paving, or otherwise improving of the same, and all
costs attending the grading, paving, or otherwise improving of
said Brooke avenue, between the limits as aforesaid, shall be
payable by the said Mayor and City Council of Cumberland.
