same unless he or they shall first agree to the
reservation by said committee, out of the amount
of said appropriation otherwise coming to such
contractor or contractors, of a sum sufficient to
meet all of such unpaid claims as made known
to said committee when the building is other-
wise ready for acceptance.

spectively litigated the matters of dispute be-
tween them and had the same adjudicated by a
court of competent jurisdiction, in which event
said building committee shall pay over the
