as aforesaid, shall be deemed sufficient.
SEC. 23. And be it enacted, That if the owner
or owners of any lot or lots fronting on any

open or traveled street, avenue or alley shall
neglect or refuse to fill up, dig down, pave,
repave or repair the footways or sidewalks in
front of such lot or lots, for the space of thirty
days after service of a printed order as aforesaid,
to be reckoned in case of a publication in a news-
paper from the date of the first publication
therein, then the said county commissioners are
hereby authorized and directed to have the said
fpotways or sidewalks filled up, dug down,
paved, repaved or repaired in the manner pro-
vided for in the previous sections of this act.

SEC. 24. And be it enacted, That all the foot-
ways or pavements referred to under the pro-
visions of this act shall be paved, graveled or
planked at least five feet in width from the
curb line.
SEC. 25. And be it enacted, That all streets,
avenues and alleys that have been or may be

opened, condemned and constructed, or that
may be opened, condemned or constructed for
public use under and by virtue of any of the
acts of the General Assembly of Maryland, for
the opening and condemning of streets, avenues
and alleys in Baltimore county, and also all
streets, avenues and alleys that have been
opened and constructed for public use, and dedi-
cated by the owner or owners of the property
through which said street, avenue or alley
passes, shall be deemed and taken as a. public
highway of Baltimore county, and shall be kept
in repair by the said county commissioners, as
other roads and avenues of said county.

SEC. 26. And be it enacted, That two-fifths
the width of all streets and avenues in Balti-
more county, shall be set apart for footways
or walks, viz : one-fifth to be laid off on each
side of said streets and avenues.

SEC. 27. And be it enacted, That this act shall
take effect from the day of its passage.

Approved April 6, 1888.
