circuit court of said county, shall pay a fine of
not less than fifty nor more than two hundred
dollars, in the discretion of said justice or court;
and, in default of payment such fine, shall be
forthwith committed to the county jail for the
period of sixty days ; and from the judgment of
said justice there shall be the right of appeal to
the circuit court of the county where said jus-
tice resides, provided said appeal shall be taken
within ten days from the date of the rendition
thereof ; but execution thereon shall not be
stayed unless the party appealing shall give the
usual appeal bond to the State of Maryland, in
double the fine imposed and costs, with two
sureties to be approved by said justice.
SEC. 4. And be it further enacted, &c., That
the justices of the peace of Cecil, Harford and

Concurrent
Jurisdiction.


Baltimore counties, and the circuit courts for
each of said counties, shall have concurrent
jurisdiction in all cases that may arise under
the provisions of this act when the violation of
such provisions take place on the bay aforesaid;
and when such violation takes place on any
waters or streams forming the boundary be-
tween any of said counties, the justices of the
peace of either of said counties bounding on said
waters or stream and the circuit court of either
of said counties shall have concurrent jurisdic-
tion, and any person or persons arrested for the
violation of any of the provisions of this act may
be taken to either of said counties upon whose
justices of the peace or circuit court jurisdic-
tion is conferred by the section for commitment
and trial, and from judgment of the justice of
the peace mentioned in this section appeals may
be taken on the terms mentioned in the next
preceding section of this act.
SEC. 5. And be it further enacted, &c., That the
board of special police biennially appointed by
the Governor of the State, and charged with en-

forcement of the laws relating to wild water-
fowl, be and they are hereby constituted officers
of this state, and charged with the enforcement
of the provisions of this act so far as the same
extend to the waters of said bay and its tribu-
taries in Cecil and Harford counties northward
