Chapter 34.
AN ACT to repeal and re-enact section thirty of
article five of the Code of Public General Laws
of Maryland, title "Appeals and Errors," as
amended by rule sixteen, framed and promul-
gated by the court of appeals.
SECTION 1. Be it enacted by the General As-

sembly of Maryland, That section thirty of arti-
cle five of the Code of Public General Laws
of Maryland, title "Appeals and Errors," as
amended by rule sixteen, framed and promul-
gated by the court of appeals, be repealed and
re-enacted so as to read as follows :
30. No appeal shall be dismissed because the

transcript shall not have been transmitted with-
in the time prescribed, if it shall appear to the
court of appeals that such delay was occasioned
by the neglect, omission or inability of the clerk
or appellee, but such neglect, omission or ina-
bility shall not be presumed, but must be shown
by the appellant.
SEC. 2. And be it enacted, That this act shall
take effect from the date of its passage.
