convert the same to his own use, or fail or refuse to deliver
the same to said owner after an offer on the part of said owner

shall be deemed guilty of a misdemeanor, and upon conviction
thereof before any tribunal of competent jurisdiction, shall be
fined not more than fifty dollars, or be sentenced to imprison-
ment in the house of correction for not more than six months,
or be both fined and imprisoned, in the discretion of the court.

Effective.

SEC. 2. And be it enacted, That this act shall take effect
from the date of its passage.

CHAPTER 594.

AN ACT to repeal and re-enact with amendments Section
362 of Article 22 of the Code of Public Local Laws of
Maryland, entitled "Washington County," sub-title " Smiths-
burg," and to add an additional section to said Article 22, to
follow after Section 38b, and to be known as section 388 A.

Repeal.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That section 362 of article 22 of the Code of
Public Local Laws of Maryland, title " Washington County,"
sub- title " Smithsburg," be and the same is hereby repealed
and re-enacted, so as to read as follows :

362. The inhabitants of the town formerly known as Smiths-

name of " The Burgess and Commissioners of Geneva," and
by that name shall have perpetual succession, may be sued and
may sue, may have and use a common seal, and possess such

mixed property for the benefit of said corporation; provided,
however, that the burgess and commissioners shall not pur-
chase or acquire any real estate, unless the said burgess and
