commissioner in the exercise of his powers or in the per-
formance of his duties, such person shall be deemed guilty of
a misdemeanor, and upon conviction thereof shall be fined
not less than five nor more than fifty dollars, in the discretion
of the court.

SEC. 5. And be it enacted, That any person who shall com-
mit a nuisance by throwing any dead animal, or offal of any
kind, into any alley, highway or by-way, or any vacant lot in
Towsontown, or shall deposit or bury the contents of any
privy, or keep any hogs or pigs in a pen or yard within one
hundred feet of any dwelling house or well of water used,
shall be subject to a fine of ten dollars, to be recovered as
other fines, before a justice of the peace, and for a second

tion of the court or justice of the peace before whom con-
victed; the occupant of any premises in Towsontown, where
there is a well used for supplying drinking water, who shall
throw or permit to be thrown upon the ground, within twenty-
five feet of such well, waste water or offensive matter of any
kind from such house, otherwise than in a properly constructed
drain, shall be subject to the same penalties as above pre-
scribed.

Penalty.

SEC. 6. And be it enacted, That every owner of lots in
Towsontown and its vicinity, which are supplied with waters
from wells, or other property having tenants, shall be required
to place in each and every privy, water closet and out house,
a water-tight box for the reception of urinary and foetal mat-
ters, under a penalty of five dollars for refusing or neglecting
to supply the same, and such box shall be emptied by the
occupant; and it shall be the duty of the party occupying said
premises to have the same emptied whenever it may be full or
required to be cleaned; and any person refusing or neglecting
to have such boxes emptied shall be subject to a fine of five
dollars for each offence, recoverable as other tines before a
justice of the peace. Nothing contained in this section shall
prevent any owner of property from having constructed upon
his premises water closets or privy vaults built on correct sani-
tary principles.
