Copies of
assessment
for each
district.
|
111. It shall be the duty of the clerk of the County Com-
missioners, on or before the first day of August in each year,
to deliver to each collector a copy of the assessment of his
collection district, with the rate of taxes for said year, and the
aggregate amount placed in his hands for collection.

|
Removal
from office
for neglect
of duty.
|
112. On failure of performance of his duties as clerk or
treasurer, the incumbent, on petition to the Circuit Court for
Wicomico county by the County Commissioners and proof of
such non-performance to the satisfaction of the court, the
court may remove from office, and in such case the County
Commissioners shall elect some one else as clerk and treasurer
to fill the unexpired term of the clerk and treasurer so re-
moved, who shall fill the unexpired term of the clerk and
treasurer, so removed, until his successor is duly elected and
qualified; but his removal, as above provided for, shall not pre-
vent suit on such clerk's and treasurer's bonds, for malfeasance
or misfeasance in such office, or prosecution by indictment
when criminally liable for any act punishable by the laws of
this State.

Repeal.
|
SEC. 2. And be it enacted, That all acts or parts of acts
inconsistent with the provisions of this act be and they are
hereby repealed to the extent they are so inconsistent.

This act not
to affect
liability of
present
clerk or
treasurer.
|
SEC. 3. And be it enacted. That nothing in this act shall
be construed to affect the liability of any existing clerk or
treasurer of Wicomico county, or any collector previously
appointed in Wicomico county, or any suit therein pending ;
and provided further, that the present clerk and treasurer shall
hold his office until the next general election, or his successor
is duly elected and qualified, and he and his bond shall be sub-
ject to all the provisions prescribed by law, and to the pro-
visions of this act.

Effective.
|
SEC. 4. And be it enacted, That this act shall take effect
from the date of its passage.
