CHAPTER 360.

AN ACT to repeal and re-enact with amendments Section 172
of Article eight of the Code of Public Local Laws, title
"Cecil County," sub-title "Fish," as amended by Chapter 21
of the Acts of Assembly of 1890.

Repeal.

Be it enacted by the General Assembly of Maryland,
That section 172 of article eight of the Code of Public Local
Laws, title "Cecil County," sub-title "Fish," as amended by
chapter 21 of the acts of Assembly of 1890, be and the same
is hereby repealed and re-enacted so as to read as follows :

to fish with
pound nets

178. It shall be lawful for any owners of land bordering on
the waters of the Elk, Bohemia, Sassafras and Susquehanna
rivers and their tributaries, and North East river from Turkey
Point to the head of said river or such parts of said rivers as
may be within the limits of Cecil county, or for any one to
whom said owners maj' extend the privilege, to take or catch
fish from, nets or traps, known as pound nets, either partly
above or entirely beneath the water of said rivers, from the
first day of August to the first day of June next ensuing of
each year; provided, however, that such pound nets shall not
extend across any channel, nor shall they be so placed as in
anywise to obstruct the passage of any vessel or boat engaged
in trading in said waters; nor shall any seine or net be used in
that portion that confines the fish, the meshes of which are
less than one and a quarter inches square; nor shall such stake
or post be permitted to remain in said waters for a longer
period than prescribed in this act for the placing of pound
nets; provided, however, that it shall be lawful to take or
catch fish in the manner provided by this section in the North
East river and its tributaries from Turkey Point to the head
of said river, only during the months of March, April and
May of each year.

Effective.

SEC.2. And be it enacted, That this act shall take effect
from the date of its passage.
