SEC. 17. The several turnpike companies owning roads run-
ning into the town, may cede to the town such parts of their
roads as lie within the limits of the town, upon such terms as
may be agreed upon between the burgess and commissioners
and the companies, and the same when ceded, shall in all
respects be subject to the same regulations as the public streets
of said town.

SEC. 18. The burgess and commissioners shall have power
to condemn the parts of all public highways lying within the
limits of the town for public use, and to open, widen, straigh-
ten or close up the same in whole or in part.

SEC. 19. That the burgess and commissioners of Sharpsburg
may impose and appropriate fines, penalties and forfeitures for
the breach of their ordinances, and that all tines shall go to
the corporation, and shall be appropriated as directed by
ordinances.

SEC. 20. That the sheriff of Washington county shall receive
and safe keep in the jail of said county, all persons who shall
be committed thereto for a breach of any of the ordinances of
said town, according to the tenor of said commitment, and in
the same manner and under the same regulations as persons
committed for violations of the laws of the State.

SEC. 21. That in case of any person or persons who shall be
found guilty of the violation of any ordinance of said corpora-
tion, it shall or may be lawful for any justice of the peace of
Washington county, residing within the corporate limits of
said town, to hear and try such case, and upon conviction of
the offender, to impose such fine as is prescribed by the par-
ticular ordinance under which said person or persons is or are
tried and convicted, not to exceed the sum of twenty dollars;
and upon failure or refusal of the party convicted thereof to
pay such fine and cost, to commit the person or persons con-
victed as aforesaid to the jail of said Washington county for
the time prescribed by the said ordinance, unless the person
convicted shall pay such fine and costs before the day limited
in such commitment;, in which case the said justice of the
peace who has directed such commitment shall issue his order
to the sheriff of said county to release such person or persons ;
provided, such commitment shall not continue for more than
thirty days.
