residents of said town next preceding the election, and at least
twenty-five years of age; they shall take the oath of office as
hereinafter prescribed for town officers, and remain in office
until their successors are elected and qualified.

SEC. 6. In case of a vacancy in the office of burgess, by
death or otherwise, then, and in that event, the assistant bur-
gess shall hold the office of burgess, with all its powers, rights
and duties, until the next general election, and he shall take
oath of office and qualify as required of the burgess; and the
commissioners, at any general or special meeting, shall elect a
successor to fill the unexpired term of the assistant burgess,
and the person receiving a majority of the whole number of
members of the commissioners shall be entitled to fill the office
of assistant burgess of said town for the unexpired term
caused by thus becoming burgess; and the clerk of said bur-
gess and commissioners, and if there be no clerk elected, the
regular chosen secretary of the said burgess and commissioners,
shall certify the vote so taken to elect such successor, under hie
hand and seal of the town, to the clerk of the Circuit Court
for Washington county within five days after such election ;
and the clerk of said court, on receipt thereof, shall immedi-
ately notify the persons elected, who shall in three days qualify
by taking the oath of office hereinafter provided for town
officers; and if such person shall fail to qualify as hereinafter
provided, another election shall be held, and so on till the
vacancy is finally filled.

SEC. 7. The burgess, by virtue of his office, shall preside at
all meetings of the commissioners, and in case of a tie, shall
have the deciding vote; and in the absence of the burgess, the
assistant burgess shall assume all the duties of the burgess.
The burgess shall see that the ordinances of the town are
faithfully executed, and shall report to the commissioners at its
first meeting, after the first day of January in each and every
year, the condition of the municipal affairs. He shall have
the power of vetoing any ordinance as provided for in
section ——; and for his service shall receive an annual salary
of ten dollars; and the assistant burgess shall receive for his
services an annual salary of ten dollars; and neither burgess or
assistant burgess shall receive any other fee or compensation
whatever.
SEC. 8. And at the same time and in the same manner as
provided for in section five of this act for electing burgess and
assistant burgess, there shall be elected five commissioners for
