Proviso.
|
other person or persons to fill the office or offices thus made
vacant for the unexpired term; provided, however, that said
clerk or bailiff must have at least ten days' notice of the
intention of the said commissioners to act upon the charge
of misconduct or neglect of the bailiff or clerk, together with
a copy of the charges against said clerk or bailiff; and they
shall be entitled to a hearing before said commissioners
before action is taken thereon.
SEC. 7. And be it enacted, That the said commissioners
or a majority of them have full power and authority annually

Authority to
appoint a
treasurer
and attorney
|
in the month of May, at their first meeting aforesaid, to
appoint a treasurer and an attorney for said town and fix
the compensation of such officers, and they shall also have
power to appoint policemen and such other officers as they
may deem necessary, and the said policemen and the bailiff
shall serve warrants and make arrests for the violations of
the ordinances of said town, and for this purpose the bailiff
and policemen are hereby vested with the same power and
authority as constables of said county now have under the
laws of this State, and such policemen and other officers
shall receive such compensation as said commissioners shall
deem proper; and said policemen and treasurer appointed

Oath to be
taken.

under this Act shall, before entering upon the duties of their
said offices, make oath before said commissioners that they
will faithfully and impartially perform the duties required
of them, respectively, according to the best of their skill and
judgment, without favor, affection or prejudice; and the presi-
dent or the acting president of the commissioners shall

administer said oath; and the said treasurer in addition to
the oath shall give bond in the sum of two thousand dollars
for the faithful performance of his duties.
SEC. 8. And be it enacted, That the said commissioners
shall have power to pass all ordinances necessary for the

good government of the said town; to prevent, abate and
remove nuisances in or upon the streets, highways, lanes or
alleys, drains or watercourse, or in or upon any lot or lots ad-
jacent thereto, and to provide for imposing a fine or fines upon
any person or persons causing or creating any such nuisance
or obstruction; to remove or cause to be removed houses
or other structures that may be dangerons to persons passing
along or over any of the streets, lanes, alleys or highways of
said town; to make reasonable regulations for the erection and
