qualify on the first Monday in each year next succeeding
their respective elections by taking the following oath, to be
administered by some justice of the peace: I, ———— , in the
presence of Almighty God, do solemnly promise and swear (or
affirm) that I will execute the office of commissioner of Bar-
ton (or clerk or bailiff, as the case may be), to the best of my
ability, without fear, favor, partiality or prejudice; and at

their annual meeting on said date the commissioners shall
elect one of the said commissioners as president of the com-
missioners, who shall be the acting Mayor of the said town,
who shall serve until the first Monday of May next succeed-
ing his election, whose duty it shall bs to preside at all
meetings of the commissioners, execute ordinances passed
by the said commissioners, and who shall be ex officio 'chair-
man of all committees of said commissioners, which said
committees shall be appointed by the said president; they
may meet as often as occasion may require and not less than
once a month.
SEC. 5. And be it enacted, That the said commissioners of

Barton shall appoint every year, at least ten days before the
day of election, three judges to hold said election; they shall
keep the polls open from 5 o'clock P. M. to 8 o'clock P. M.,
and shall conduct said election in the same manner in which
elections were conducted prior to the Australian ballot, and
the said judges shall make returns under their oaths, hands
and seals to the clerk of the Circuit Court for Allegany
County of the persons elected and the positions to which
they have been elected.
SEC. 6. And be it enacted, That the said commissioners
or a majority of them shall define the duties of the clerk and

the bailiff and allow them such compensation for their ser-
vices as they may think proper; and all ordinances passed
by the said commissioners or a majority of them shall be
entered by the clerk in a book to be kept for the purpose
and shall at all times be open for the inspection of any per-
son or persons interested, and copies of all ordinances within
thirty days after their passage shall be posted in at least
three public places in said town, one of which shall be at
the place of meeting of said commissioners, for official mis-
conduct or neglect of duty of the bailiff or clerk during their
respective terms of office; the said commissioners may
remove the clerk or bailiff so offending and shall elect some
