SEO. 2. And be it enacted, That this Act shall take effect
from the date of its passage.
Approved February 16, 1906.

CHAPTER 8.
AN ACT to authorize the Highways Commission of Balti-
more County to use the unappropriated surplus in the
County treasury to reimburse the road fund for a portion
of the loss sustained by reason of damage to the county
roads and bridges from destructive floods during the year
1905.

CHAP. 8

WHEREAS, The public roads and bridges of Baltimore
county were greatly damaged, and in many instances totally
destroyed by unusual and destructive floods occurring during
the year 1905, requiring the Highways Commission of said
county to expend on their repair the sum of over sixty-five
thousand dollars ($65,000) out of the funds levied for ordi-
nary and usual road purposes, thereby depriving the whole
people of said county of the benefit of that sum which
would otherwise have been used for usual repairs and
improvements to the county roads in general; and
WHEREAS, There is now in the County treasury, due the
county from uncollected taxes and other sources, the sum of
about forty-five thousand dollars ($45,000), not appropriated
for-other purposes, and constituting a surplus which has
been accumulated by the County Commissioners during the
past few years, through the exercise of great economy and
care in the administration of county affairs; and
WHEREAS, The Highways Commission of said county is
limited by law to the expenditure of the sum levied by the
County Commissioners of said county for road purposes,
and said County Commissioners are by law prohibited from
expending for any specific purpose any greater or other sum
than they have actually levied for such purposes; therefore,

Preamble.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That the Highways Commission of Baltimore County
be and it is hereby authorized and empowered to reimburse
the road fund for a portion of the loss sustained by reason
of damage to the county roads and bridges from destructive
floods during the year 1905, and expend for road purposes
