SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 62 of Article 1 of the Code of Public

CHAP. 247

Local Laws of Maryland, entitled "Allegany County," sub-
title "Cumberland," as repealed and re-enacted with amend-
ments by Chapter 56 of the Acts of 1892 of the General
Assembly of Maryland, be and the same is hereby repealed
and re-enacted with amendments, so as to read as follows :

Section 62. The Mayor shall by virtue of his office see that
the ordinances of the city are duly and faithfully executed.

Repeal and
re-enact.

He shall appoint subject to the confirmation of the City
Council all the officers of said city who are not made elective
by the people or the City Council, except the city treasurer
and collector, who shall be elected by the City Council, and
excepting the water rent collector and superintendent and all
other employes and officers of the water department, who
shall be appointed and be under the control of the board of
water commissioners hereinafter provided for, and excepting
also the police magistrate, who shall be appointed as follows :
The Mayor shall on the first Monday of June, 1906, and
every two months thereafter designate one of the justices of
the peace having jurisdiction in the city of Cumberland to
act as police magistrate for the period of two months, and
no justice shall be named for a second period of two months
until all of the said justices have in turn served a period of
two months as police magistrate. He shall annually, the
first Monday in May, report to the Council in writing the
general state of the city, with an accurate account of the
moneys received and expended, which report shall be pub-
lished in each of such two newspapers in said city of oppo-
site political faith as shall be designated by the City Council,
giving full and particular statement of all receipts and dis-
bursements. He shall have power to remove any of the
officers, agents or servants by him appointed for neglect or
violation of any duties pertaining to their respective offices
and shall appoint others in their stead and shall report such
removal and appointment to the City Council at its next
regular meeting, for its approval or disapproval, he shall
have general supervision of the city and shall submit from
time to time to the Council such recommendations as he
shall deem proper. He shall also by virtue of his office be
chairman of the trustees of the sinking fund, and of the
board of health, and shall discharge all the duties pertaining
